Thank you for using SemperStream, a SaaS platform for 24/7 livestreaming of YouTube content.

These Terms of Service ("Terms") govern your use of the SemperStream platform ("Platform", "Service", "we", "our", or "us"). By accessing or using our Services, you agree to be bound by these Terms, our Privacy Policy, and the YouTube Terms of Service.

If you do not agree to these Terms, you may not use the Platform.

This Agreement is governed by Dutch law. Disputes will be exclusively handled by the courts of Amsterdam, unless otherwise required by mandatory law.

3. Definitions

User: You, an individual or entity using our Services.

Content: Any digital material you upload, stream, or process via the Platform.

Platform: The software, servers, and infrastructure provided by SemperStream.

Balance: Your prepaid virtual wallet used only for Platform payments.

4. Eligibility & Account

You must be at least 18 years old or have parental/legal guardian consent. If registering on behalf of a company, you affirm you have authority to bind the entity to these Terms.

You are responsible for:

Providing accurate account info

Keeping your login credentials secure

Updating billing/payment information

All activity under your account

5. Services and Usage

SemperStream offers cloud-based streaming and content broadcasting infrastructure designed to automate YouTube livestreams. We may engage third-party providers to offer the Services.

By using our Services, you confirm you've read and accepted our Privacy Policy. If you do not agree, you must not use the Platform.

6. Intellectual Property

We retain all rights to our Platform software and branding. You retain ownership of all content you upload.

You agree not to:

Copy, modify, distribute, or sublicense the software

Reverse engineer or attempt to access source code

Disrupt or interfere with the Platform's operation

7. User Responsibilities

You confirm that:

You have the legal rights to the Content you upload

Your Content does not infringe third-party rights or laws

You will comply with YouTube's API Terms and the Google API Services User Data Policy

You indemnify SemperStream for any losses or claims arising from your misuse of the Platform or violations of these Terms.

8. Subscriptions & Payments

SemperStream offers paid monthly subscriptions. New users receive a 7-day free trial.

Accepted payment methods:

Credit/debit cards

iDEAL (for Dutch users)

PayPal

Cryptocurrency (Bitcoin, USDT, etc.)

Subscription auto-renews unless canceled prior to the billing date.

Refund Policy:

• Full refund (minus fees) within 14 days if less than 10 hours streamed

• No refund if more than 14 days passed or more than 10 hours streamed

• All refund requests must be sent from your registered email to support@semperstream.com / reach out in discord

We reserve the right to suspend or terminate accounts for failed payments or abuse of refund requests.

9. Termination

You may cancel your account at any time. Upon termination, your data may be deleted unless legally required to be retained (e.g., for anti-fraud, AML compliance).

10. Limitation of Liability

To the extent permitted under Dutch law, SemperStream shall not be liable for:

Indirect or consequential damages

Loss of profits or business reputation

Third-party service outages or errors

Services are provided "as is." We do not guarantee uninterrupted or error-free operation.

11. Modifications

We may amend these Terms at any time. Updated Terms will be posted on our Website. Continued use of the Services means you accept the changes.
